1. Acceptance
By creating an account or using Ownly (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Ownly is a traceable creative vault: you store content, share it under per-recipient links, embed forensic markers, and request tamper-evident electronic signatures. Features may change as the Service evolves.
3. Accounts & eligibility
You must be at least 18 and provide accurate information. You are responsible for activity under your account and for keeping your credentials secure.
4. Your content & ownership
You retain all rights to content you upload. You grant Ownly a limited license to store, process, watermark, and transmit that content solely to operate the Service for you.
5. Acceptable use
You may not upload unlawful content, infringe others’ rights, or use the Service to harass or deceive. You are solely responsible for the content you store, share, and send for signature.
6. Forensic markers & accountability
Ownly embeds markers and keeps an append-only access ledger to help attribute a leak to a recipient. This is an accountability tool, not a theft-prevention or copy-protection guarantee — markers do not prevent copying, and no system can. We make no warranty that a marker survives every transformation of a file.
7. Electronic signatures (SES)
Ownly’s e-signature is a Simple Electronic Signature (SES) under US ESIGN/UETA and eIDAS. It records intent, consent, attribution (verified control of an email address plus IP and user-agent), and document integrity (a SHA-256 hash anchor with an append-only, hash-chained audit trail and a completion certificate).
It does not verify a signer’s real-world identity, and it is not an Advanced or Qualified electronic signature (AES/QES), nor legally equivalent to a notarized or handwritten signature. Timestamps are server time (UTC), not an RFC-3161 trusted timestamp. You are responsible for determining whether an SES is appropriate for your document; some documents (e.g. wills, certain notices, and instruments requiring notarization or qualified signatures) require more. 8. Subscriptions & billing
Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). Plans renew automatically until cancelled; you may cancel anytime and retain access through the paid period. Fees are non-refundable except where required by law.
9. Disclaimers
The Service is provided “as is,” without warranties of any kind to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Divine Life Enterprises is not liable for indirect, incidental, or consequential damages, and our aggregate liability is limited to the amount you paid in the prior twelve months.
11. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Append-only audit records created before termination are retained as described in our Privacy Policy.
12. Changes
We may update these Terms; material changes will be notified. Continued use means acceptance.
13. Governing law
These Terms are governed by the laws of [jurisdiction — counsel to set].
